1. Application of South African Law
1.1 These Terms & Conditions are governed by the laws of the Republic of South Africa, including the Consumer Protection Act, 68 of 2008 (CPA) and the Protection of Personal Information Act, 4 of 2013 (POPIA).
1.2 Nothing in these terms is intended to unlawfully limit any consumer rights provided by South African law.
2. Products & Orders
2.1 All products displayed are subject to availability.
2.2 Product images and descriptions are as accurate as reasonably possible; minor variations may occur.
2.3 Custom-made, personalised, or made-to-order products are produced specifically for the customer and are strictly non-refundable and non-returnable, as permitted under Section 17(2)(c) of the CPA.
2.4 We reserve the right to refuse, cancel, or limit any order at our discretion.
3. Pricing & Payment
3.1 All prices are displayed in South African Rand (ZAR).
3.2 Prices may change without notice and do not affect orders already paid.
3.3 Orders will only be processed once full payment has been received.
4. Shipping & Delivery (BobGo)
4.1 We make use of BobGo for shipping and courier services.
4.2 Delivery fees are calculated at checkout and are for the buyer’s account, unless otherwise stated.
4.3 Delivery timeframes are estimates only and are dependent on courier performance.
4.4 Once an order has been handed over to the courier, risk passes to the customer, as allowed under South African law.
4.5 We are not liable for delays caused by couriers, strikes, weather conditions, or events beyond our control.
4.6 Customers are responsible for providing accurate delivery details. Incorrect details may result in delays or additional costs.
5. Cooling-Off, Returns & Refunds
5.1 In accordance with Section 16 of the CPA, customers may return goods within 7 (seven) days of delivery, subject to the conditions below.
5.2 Returned goods must:

Be in original packaging

Be in a resalable condition
5.3 All return shipping costs are for the buyer’s account, unless the product is defective or incorrect.
5.4 No returns or refunds will be accepted for:

Custom-made or personalised products

Special or made-to-order items

Products that have been opened, used, altered, or damaged
5.5 Refunds, if approved, will be processed after inspection and may take several business days to reflect depending on the payment method used.
6. Defective, Damaged or Incorrect Goods
6.1 If goods are delivered damaged, defective, or incorrect, the customer must notify us within 48 hours of delivery, including clear photographic evidence.
6.2 Failure to report within this timeframe may result in the claim being declined.
6.3 Valid claims will be handled in accordance with Section 56 of the CPA.
7. Limitation of Liability
7.1 To the fullest extent permitted by South African law, VLuminous shall not be liable for any indirect, incidental, or consequential loss or damages.
7.2 Products are used at the customer’s own risk and in accordance with any instructions provided.
8. Intellectual Property
8.1 All content on this website, including text, images, branding, and designs, remains the intellectual property of VLuminous unless otherwise stated.
8.2 No content may be copied, reproduced, or used without written permission.
9. Privacy & POPIA
9.1 We collect and process personal information in compliance with POPIA.
9.2 Personal information is used solely to fulfil orders, provide customer support, and meet legal obligations.
9.3 Customer data is not sold or shared with third parties except where required (e.g. couriers and payment processors).
10. Jurisdiction
10.1 Any dispute arising from the use of this website or purchases made shall be subject to the jurisdiction of the courts of the Republic of South Africa.
